Re: Chromium Electroplating Emission Standard: Compliance Extension Request
Dear Mr. Miller:
On June 30, 1995, DELPHI Energy & Engine Management Systems (DELPHI) sent an initial notice to the United States Environmental Protection Agency (U.S. EPA), Region 5. This notice informed Region 5 that DELPHI operates a decorative chromium electroplating tank at the companys Flint, Michigan facility (Flint tank). Such tanks are subject to the National Emission Standard for Chromium Emissions from Hard and Decorative Chromium Electroplating and Chromium Anodizing Tanks, 40 CFR part 63, subpart N (chrome standard). The compliance provisions of this standard, 40 CFR Section 63.343, require that decorative chromium electroplating tanks comply no later than January 25, 1996.
The compliance provisions allow a source to request up to one additional year to comply with the chrome standard. On October 10, 1995, you sent Region 5 a letter requesting a four month compliance extension for the Flint tank. Your letter states that DELPHI will comply by shutting down the Flint tank. However, the company must first complete union negotiations and find a qualified supplier of chrome-plated parts for the facility. Region 5 finds this request reasonable.
On August 7, 1995, the U.S. EPA Administrator delegated the authority to grant compliance extensions to the Regions. Under this authority, Region 5 extends the chrome standard compliance date for the DELPHI Flint tank to May 25, 1996. Region 5 grants this extension on one condition. DELPHI must notify the U.S. EPA and the Michigan Department of Environmental Quality, in writing, when it shuts down the Flint tank.
