CWA Storm Water Monitoring (40 CFR 122)

Facilities that are permitted under EPA’s General Storm Water Permit Program and report to the Toxic Release Inventory are required to monitor storm water run-off on a semi-annual basis and submit the previous year’s data to their regional EPA office.

Facilities are required to apply for coverage under a state or federal industrial storm water permit. Most facilities will be required to submit monitoring and/or inspection reports. Refer to your permit for details and due dates.

Posting of Annual OSHA Summary (29 CFR 1904.5)

Employers are required to post an annual summary of occupational injuries and illnesses for each facility, covering the previous year.

Summary must contain year’s totals from the OSHA 300 Log, calendar year covered, facility name/address, certification signature, and date. Summary must be posted in a conspicuous place or place where notices to employees are customarily posted. Summary must remain posted until March 1.

Many facilities use this date to satisfy the annual OSHA requirement that employers inform employees of their right to access exposure and medical records (29 CFR 1910.20 (g)).

Submission of Biennial Hazardous Waste Report (40 CFR 262.41)

Generators that ship hazardous waste off-site to a U.S. treatment, storage, or disposal facility must submit a Biennial Report A (EPA Form 8700-13A) to the EPA Regional Administrator, covering generator activities during the previous year.

Report must include: (1) generator’s EPA identification number, name, and address; (2) calendar year covered by report; (3) EPA identification number, name, and address for all receiving facilities; (4) EPA identification number/name for all transporters; (5) identification/quantity of all wastes shipped; (6) description of efforts taken to reduce volume/toxicity of waste generated; (7) description of changes in volume/toxicity of waste achieved during calendar year; and (8) signed certification.

Submission of Hazardous Chemical Inventory Form (40 CFR 370.25)

Covered facilities are required to submit an inventory form to state emergency response commission, local emergency planning committee, and local fire department with jurisdiction over the facility.

All hazardous chemicals (substances that trigger OSHA’s Hazard Communication requirements) present at a facility at any one time during the preceding calendar year in amounts equal to or greater than 10,000 pounds and extremely hazardous substances (see 40 CFR 355, App.A) present at the facility in amounts greater than or equal to their threshold planning quantity at any one time during the preceding calendar year must e reported.

Covered facilities may submit either the Tier I or the Tier II Form. Most choose to submit the Tier II Form, which some states require.

Some facilities use this date to determine whether any new chemicals have entered the workplace, triggering the requirement that a material safety data sheet be submitted to the state emergency planning commission, local emergency planning committee, and local fire department with jurisdiction over the facility (40 CFR 370.21).

 

Submission is required within three months of obtaining a covered substance in amounts greater than threshold planning quantities.

CWA semiannual Report on Continued Compliance for Indirect Dischargers (40 CFR 403.12(e))

Facilities that discharge to publicly owned treatment works (POTWs) and, therefore, are subject to categorical pretreatment standards, are required to submit to local Control Authority a report indicating the nature and concentration of pollutants in their effluent which are limited by pretreatment standards.

Report is required to include record of measured or estimated average and maximum daily flows for the reporting period. Depending upon how their discharge is limited (e.g., mass, concentration, or production limit), facilities are required to include information that enables the Control Authority to determine whether a facility has been in compliance.

DOT Hazardous Material Transportation Registration (49 CFR 171)

Facilities that either transport or offer for transportation certain hazardous materials must annually renew their Certificate of Registration before offering for transport or transporting hazardous materials.

Facilities are covered if they offer for transport a shipment of at least 5,000 lbs. (2170 kgs) – about 10 drums of one hazard class; or a bulk package containing 3,500 gals. (468 cubic feet); or one liter (1.06 quarts) of a "gas poisonous by inhalation." The registration fee is $300 per year.

Toxic Release Inventory Report (40 CFR 372)

Covered facilities must submit Form R to federal EPA as well as state environmental agencies. Form R reports the quantities of on-site releases as well as off-site transfers of listed toxic chemicals for the previous calendar year.

Covered facilities are facilities with more than 10 employees, are classified by the SIC codes 20-39 (PWB and assembly shops are in the SIC 36 classification) and manufacture, process, or otherwise use toxic chemicals above certain thresholds. If you manufacture or process a listed toxic chemical, the threshold is 10,000 pounds. If you otherwise use a listed toxic chemical, the threshold is 25,000 pounds.
